BNN reports today as follows on a new case of strange proceedings in Latvia:

A few days ago BNN reported that «Kālija parks», a most profitable and one of the largest organic fertilizer processing terminals in the world, is being bushed to the borders of bankruptcy by «TM SECURITY» security firm. BNN’s assessment of this most complicated situation is now backed up by the official press release from «Kālija parks».

Last week media channels presented information about the insolvency of «Kālija parks». This allegation was based on the lawsuit against «Kālija parks», by «TM Security». The latter claims that «Kālija parks» is indeed approaching bankruptcy, because of their failure to pay for «TM Security» so called “provided security services” on the sum of 154 331.53 LVL.

The management of «Kālija parks» are convinced that «TM Security» are making serious steps in destroying our company’s reputation and completely stopping our company from operating in the future. Furthermore it seems like they are attempting to assume control, their every action so far indicates just that:

The suitor’s mixed reputation because of the so called «transit wars» that is associated with their protection of «Ventbunkers» and direct link to the ex-management of «Kālija parks».

The unreasonable sum of penalty fees that cannot be explained in any sane way.

«TM Security» complete and utter refusal to negotiate and or reason in court in order to resolve the fight over their security services

Perfect timing – the period of raw material supplier negotiation campaign for the next year. A time when any bad publicity, especially about bankruptcy, for «Kālija parks» made in press would have catastrophic consequences for their reputation, and in turn financial problems.

The developing situation is doubly unpleasant considering that the contract with «TM Security» on behalf of «Kālija parks» was signed by people who had no right of signature, this fact was proven to be true by the decision of Ventspils court during the review of the case № С40122210 on 07.04.2011. So this means that the contract is in fact, illegitimate and void.

It is worth mentioning that after hard years of work and despite the economic crisis and changes in the terminal’s partnership structure, we are working with good profitability and are confidently working our way to the future. We have good conditions for increasing our goods turnover as well as upgrading our terminal. With all this going on we cannot be distracted by «TM Security» biased tactics. We value any probable loses both in terms of reputation and finances «Kālija parks» could suffer regardless of the court’s decision. And we are hope that the outcome will prove to be detrimental to Europe’s second largest organic fertilizer transit terminal.

We sincerely hope that the people behind this affair fully comprehend the possible consequences of their actions both for the reputation of our company and the field of transit business in Latvia as a whole, as well as the possible consequences for «TM Security» as a result of their actions.

TheVentspils court hearing of the «Kālija parks» insolvency case is scheduled to be on the 8th of December. And the court’s decision on this matter would become an indicator of the level of civility in leading a business in the country – a member of the EU. We are confident, because raider takeover attempts, a spectacle that has not been seen in Latvia for quite some time, is already being associated with the name «Ventspils», and should be prevented swiftly and mercilessly.

We put our hopes in an interference of the relevant government bodies specifically the law enforcement whose actions would prove to be both effective and in accordance with the country’s legal system. It is time to put an end to these inadequate actions against transit enterprises in Ventspils!
